By downloading or using the BirdNerd app, you agree to these Terms and Conditions. Please read them before using the app.

Use of the App

You may use BirdNerd for its intended purpose as a bird sound identification and observation tool. You may not copy or modify the app, any part of the app, or its trademarks. You may not attempt to extract its source code, create derivative versions, or use the app in a way that infringes intellectual property rights.

The app, its design, trademarks, copyright, database rights and other intellectual property rights belong to Oleg Kenunen or their respective rights holders.

Service Availability and Changes

BirdNerd is provided as is. The aim is to keep the app useful and functional while the service remains available. Features may be changed, limited, suspended or discontinued. Paid services will not be introduced or changed without making the applicable price clear before purchase.

No guarantee is made that the app, recognition service or any particular feature will remain available indefinitely or operate without interruption.

Recognition Results

BirdNerd provides probabilistic species suggestions based on submitted recordings. Results may be incomplete or incorrect, particularly when recordings contain background noise, several species, uncommon species, or sounds outside the current coverage area.

Recognition results should be treated as identification hints rather than authoritative determinations. You remain responsible for how you interpret and use the results.

Internet Connection and Device Requirements

Some functions, including sound identification, require an active Internet connection. The connection may be provided through Wi-Fi or a mobile network. You are responsible for data charges, roaming charges and other fees imposed by your network provider.

You are responsible for keeping your device, operating system and access to the app secure. Modifying the device in ways that disable platform security features may affect the security or operation of BirdNerd.

Subscriptions and Purchases

Subscriptions and other purchases are processed through Google Play. Prices and billing periods are shown before purchase. Subscriptions can be managed or cancelled through the user’s Google Play account.

Refund eligibility is determined by Google Play policies and applicable law. Removing the app from a device does not automatically cancel an active subscription.

Privacy

BirdNerd stores and processes information required to provide the Service as described in the Privacy Policy. You are responsible for keeping your device and access to the app secure.

Third-Party Services

The app may rely on third-party services, platforms and information sources. Their availability and operation are outside BirdNerd’s direct control. Third-party services may be governed by their own terms and privacy policies.

Updates and Compatibility

BirdNerd is currently available for Android. System requirements may change, and continued use may require installing updates. Compatibility with every device or future Android version is not guaranteed.

If the Service is discontinued, the rights granted under these Terms will end and you may need to stop using and remove the app.

Limitation of Responsibility

To the extent permitted by applicable law, BirdNerd is not responsible for indirect loss resulting from interrupted access, network availability, device failure, third-party services, or reliance on recognition results.

Nothing in these Terms limits rights or remedies that cannot legally be limited under applicable consumer law.

Changes to These Terms

These Terms and Conditions may be updated from time to time. Updated terms become effective when they are published on this page. The date of the latest revision is shown at the top of the page.
